Federal High Court, National Industrial court Being Courts of coordinate Jurisdiction Stops CCT, From Prosecuting CJN


According to the information reaching divaviva111.com, three courts have halted the arraignment of Walter Onnoghen, the serving Chief Justice of Nigeria by the Criminal Court of Tribunal.





The courts are the Federal High Court in Abuja, the Federal Capital Territory (FCT), the Industrial Court, has halted the arraignment and trial of Walter Onnoghen, the Chief Justice of Nigeria (CJN), before the Code of Conduct Tribunal for alleged fraudulent asset declaration.





By an ex parte application in the suit FHC/ABJ/CS/27/2019 moved by Mr. R.A Lawal-Rabana (SAN), before Justice Maha today Monday 14th January, the ex parte application filed in the suit marked FHC/ABJ/CS/28/2019 ‎was moved by Mr. Jeph Njikonye.





Justice Maha granted the application and stopped the planned arraignment, also ordered the service of court”s documents in relation to the substantive suits on the defendants and adjourned to January 17 for parties to appear for possible hearing.





In the same vein, via an ex-parte application filed by Peter Abang at the National Industrial Court of Nigeria, abuja Judicial Division today also for an interim order restraining the arraignment the Federal Government of Nigeria, the Code of Conduct Tribunal CCT, CCB, Inspector General of Police from prosecuting the CJN in the matter between the The Federal Republic of Nigeria v Justice onnoghen Nkanu Walter pending the determination of the motion, His Lordship, Hon. Justice Samuel Kado granted the application.





Justice Walter Onnoghen will be the first Chief Justice of Nigeria to be arraigned before a Tribunal barely two years after assuming office.
