Judicial History As Impunity Takes Control. CJN Removed. Another Sworn just 3 weeks To Nigerian Election
Impunity for the first time has taken control as everything built by the judiciary has been lost ot people who think they can do things the way they want.
Recall that the Court appeal yesterday, issued a Restraining Order stopping everything relating to the CCT trial of the Chief Justice of Nigeria, Justice Walter Onnoghen.
What's worse according to some lawyers who have reacted to this news is that the order President Buhari relied on was an Ex-parte Order, meaning that the other party, the CJN was not put on notice to defend himself.
The question now is, How can you shave a man's head in his absence?
According to the provisions of the Constitution, The removal of the CJN is unconstitutional, illegal and of no effect as the Nigerian Constitution strongly recommends that Supreme Court judge can only be removed from office by two-thirds of the Nigerian Senate. Mr Onnoghen has been on the Supreme Court since 2005
See the Order Buhari relied on that was secretly granted by the Code of Conduct Tribunal, an asset compliance agency under the control of the president.
